Australian Clinical Labs Class Action
Omni Bridgeway is funding a class action brought by William Roberts Lawyers against Australian Clinical Labs (ACL) in relation to a 2022 data breach affecting its Medlab Pathology business unit (Medlab), which resulted in the personal and sensitive information of its customers being compromised and released on the dark web.
If you were a customer of ACL or Medlab, and affected by the data breach, you may be eligible to take part in the class action and claim compensation.
Background
ACL is headquartered in Victoria and is one of the largest private hospital pathology businesses nationally. In December 2021, ACL acquired Medlab, a privately owned pathology business that provided services in New South Wales and Queensland.
As part of the acquisition, ACL acquired Medlab’s information technology (IT) systems. Relevantly, Medlab’s IT systems held personal and sensitive information, including (but not limited to) health information, passport numbers, credit card information, Medicare information, contact information, and other financial information of its customers.
In or around February 2022, a threat actor known as the Quantum Group accessed, and installed ransomware on, Medlab’s IT systems. On or before 16 June 2022, around 86 gigabytes of data from Medlab’s IT systems, containing the personal and sensitive information of its customers, was published on the dark web.
The class action seeks compensation for the harm caused to customers of ACL or Medlab due to the data breach, including distress or psychological harms, financial harm and material inconvenience.
How Much Will It Cost?
The class action is funded by Omni Bridgeway on a “no win, no pay” basis in accordance with the terms of a funding agreement or terms imposed by the Court. If the class action is successfully resolved and there is a recovery of compensation, Omni Bridgeway will be entitled to reimbursement of the costs it has spent plus a commission from such recovery only.
There are no ‘out of pocket’ costs for group members to pay. Group members do not have to pay anything in the event that the class action is unsuccessful, as Omni Bridgeway agrees to pay any legal costs that might be awarded to Australian Clinical Labs or any other respondents.
