You can apply to be a member of the Scheme and to participate in the class action by completing the online Application Form (which is set out in the PDS) in 6 quick steps:

This Scheme relates to a class action or potential class action or multi-party litigation (the Class Action) against Scenic Tours Pty Ltd (the Respondent).

Passengers on river cruises operated by Scenic Tours Pty Ltd between 1 June 2018 to 31 December 2018 on the Rhine-Moselle-Main-Danube river systems and had their cruise disrupted are invited to complete and return the Application Form. Further information in relation to the eligibility criteria can be found in section 3 of the PDS.

To sign up online you will be asked to provide the name of the person who was a passenger on the relevant river cruises. If you travelled with more than one person on the relevant cruise, you will each be required to review the PDS and complete a separate Application Form and Somerville Legal Retainer Agreement should you wish to both participate as a funded member of the Class Action. 

The costs of running the Class Action will be met by Omni Bridgeway on the terms of the Scheme’s constitution as those terms are explained in the PDS. Omni Bridgeway will pay Somerville Legal’s fees (save for a portion carried by Somerville Legal), the costs of any investigators, any expert witnesses or other consultants necessary to bring the claim. Omni Bridgeway will also post security for costs, or finance the Somerville Legal to post security for costs, if that is required. You will not have to pay any of these costs. You will not have to pay anything to acquire your interest in the Scheme. Further information in relation to costs can be found in section 13 of the PDS.

If you apply to become a member of the Scheme, you have a 21-day cooling-off period, starting from the day you send Omni Bridgeway your signed Application Form, to determine whether participation in the Scheme and the funding arrangements with the Funder meets your needs.  If during the 21-day cooling-off period, you decide that the funding does not meet your needs, you may withdraw your application by notifying us in writing at [email protected]. Further information in relation to the cooling-off terms can be found in section 17 of the PDS. 

 

The Omni Bridgeway portal is a client portal whereby you can log in and see details of the Omni Bridgeway funded claims you have signed up for. You can update your contact details and access information that is related to your claims. 

You have no obligation to apply to participate in the Class Action, but if you decide not to complete and return an Application Form, you might lose the opportunity to recover compensation in the Class Action. This is because Omni Bridgeway presently intends to fund the Class Action only for those persons who have completed and returned an Application Form by the current deadline, which is 15 June 2022. If Omni Bridgeway postpones the current deadline, it will post a new date on its website. Please see section 3 of the PDS for further details.
